Please note that the cost of letters inclusive of VAT together with the costs of the issue of claim including VAT and court fee must be paid on account when we are instructed.
The price quoted for the issue of the claim, includes drafting the necessary claim form with a standard description such as goods sold, professional services rendered. In complex matters such as a claim or breach of contract or similar, there would be additional charge as per hourly rate for drafting special particulars of claim. The cost includes sending off the claim to the County Court Money Claims Centre for issue. Included in the fixed fee is the work done by us in carrying out an Experian search in respect of the limited company, PLC or limited liability partnership as appropriate and advising you if there is any adverse information. Please note the actual cost of the search being £3.00 plus VAT will be charged in addition.
If the debtor/defendant does not respond to the claim, then there is an additional cost for the entry of judgment as set out above. If any additional work is necessary such as telephoning or emailing the court, dealing with any telephone calls or correspondence from the debtor/defendant, this will be charged as per hourly rate.
Please note that the costs quoted for judgment include the preparation of and applying to the court for judgment to be entered. The costs quoted do not include any enforcement action and you will be advised of this after judgment has been entered and you will be provided with a copy of the judgment. Any additional work following the entry of judgment will be charged as per hourly rates.
Once judgment has been entered we can advise you as to various enforcement options and what we think would be the best course of action taking into account what is known about the debtor/defendant and the value of the debt. This is charged in addition as per hourly rate.
The price is quoted for the letters mentioned above include receiving your instructions, drafting and sending out the necessary letter to the debtor and sending you email confirmation of this being done. If the matter is involved, and it is necessary to draft a custom drafted letter such as a winding-up or special demand letter, you will be advised of this, given an estimate and the cost will be as per hourly rate.
If you need guidance on how best to proceed given the particular circumstances of the debt you are owed, advice on this can be given either by telephone or email and is charged in accordance with hourly rates.
Please also note that we will claim statutory interest and compensation in addition to the debt pursuant to the Late Payment Act so this may increase the amount of your claim which could result in a higher court fee and solicitors costs being charged. We will advise you of the appropriate cost and court fee so that payment can be made on account.
If we send a demand letter to a limited company, PLC or LLP, we can give a minimum of seven days notice and after that we will seek your instructions with regard to the issue of a claim. If we have to send a letter of demand to a consumer or sole proprietor, we have to send a demand in accordance with the late payment protocol, giving 30 days notice of intended legal action to the debtor and we will respond to you after that 30 days or sooner should there be a response from the debtor.
Upon the issue of a claim, it can take on average a minimum of fourteen days for the court to issue the claim after it is sent off by us and we will then receive the notice of issue and service and we can advise you as to the date the claim was served and the debtor/defendant has fourteen days to respond. On average therefore it could be approximately one month from the date the claim is sent off to court for issue and judgment is entered on the assumption that the defendant does not respond to the claim. If there is a response and the claim is defended then of course the time to conclude the matter will be much longer and we will give you an estimate of timescales once we know this.
