Care Quality Commission and Care Standards Tribunal
A wide range of businesses are required by the Health and Social Care Act 2008 to register with the Care Quality Commission (CQC).
We can advise in respect of:
✓ The need to register
✓ The registration process
✓ Police investigations
✓ CQC investigations
We represent at interviews and court or tribunal hearings.
The CQC has the power to make emergency applications which could not just suspend, but cancel your registration forthwith. Contact us immediately should you require representation at such hearings.
Some examples of our work include:
We were consulted by a Nursing Care Agency following a complaint from a service user. We were able to advise as to the possible consequences, and the appropriate steps and measures to be taken. This advice was from both a regulatory perspective in reporting and interacting with the CQC and from an employment law perspective in respect of dealing with the individual employee facing the complaint. In respect of crisis management we also advised in relation to dealing with potentially adverse press coverage.
We were consulted by a private ambulance service provider. We represented in the Magistrates’ Court at an emergency hearing under the Health and Social Care Act and then assisted in preparing a full case for presentation to the Care Standards Tribunal.
We have represented members of care home staff in criminal prosecutions for alleged maltreatment of residents.
