Court of Appeal causes uncertainty over Tenancy Deposits.

Landlords who take deposits from tenants must protect the money in an Authorised Scheme and give Scheme information to their tenants. Failure to do so can stop landlords evicting tenants and they can incur financial penalties. Now the Court of Appeal has suggested that in some circumstances a Landlord must give the Scheme information to tenants not just at the start of a tenancy, but also again every time the tenancy is renewed or when a tenant stays on after the end of a tenancy period. This may apply even though the deposit has not been moved or touched. The same penalties will apply in default.
